AVRUPA BİRLİĞİ SU YÖNETİMİ POLİTİKALARI VE TÜRKİYE’NİN UYUM SÜRECİ ÜZERİNE BİR DEĞERLENDİRME

Özet

Bu çalışma, Avrupa Birliği’nin su yönetimi politikalarını ve Türkiye’nin bu
politikalara uyum sürecini incelemektedir. Su kaynaklarının korunması ve
sürdürülebilir yönetimi, iklim değişikliği, nüfus artışı, kentleşme ve çevresel
baskılar nedeniyle günümüzde stratejik bir önem kazanmıştır. Avrupa Birliği,
suyu korunması gereken doğal bir miras olarak görmekte ve Su Çerçeve Direktifi
kapsamında havza bazlı, sürdürülebilir ve katılımcı bir su yönetimi anlayışı
benimsemektedir. Direktif; su kalitesinin korunması, kirliliğin önlenmesi, taşkın
ve kuraklık risklerinin azaltılması gibi hedefler doğrultusunda üye devletlere
çeşitli yükümlülükler getirmektedir. Türkiye Avrupa Birliği’ne uyum süreci
kapsamında 2009 yılında İsveç dönem başkanlığında müzakerelere açılan çevre
faslındaki su konusunda önemli mesafeler almıştır. Direktif'in AB Türkiye
ilişkileri bağlamında Türkiye'de su yönetimi mevzuatı ve uygulama süreçlerine
etkisinin olduğu görülmektedir. Aynı zamanda Türkiye’nin AB’ye uyum sürecinde
parçalı yönetim gibi sorunları çözemediği ve önemli güçlükler de yaşadığı
görülmektedir. Bu kapsamda çalışmada yöntem olarak literatür taraması
kullanılarak AB çevre ve su mevzuatı ile Türkiye’nin çevre ve su mevzuatı detaylı
bir şekilde incelenerek Türkiye’nin AB kriterlerine uyumu tespit edilmeye
çalışılmıştır. Elde edilen bulgular ışığında sonuç bölümünde konunun bir
değerlendirmesi yapılmıştır.

Abstract

This study examines the European Union’s water management policies and
Turkey’s process of aligning with these policies. The protection and sustainable
management of water resources have taken on strategic importance today due to
climate change, population growth, urbanisation and environmental pressures.
The European Union views water as a natural heritage to be protected and, under
the Water Framework Directive, has adopted a basin-based, sustainable and
participatory approach to water management. The Directive imposes various
obligations on Member States in line with objectives such as the protection of
water quality, the prevention of pollution, and the reduction of flood and drought
risks. As part of its EU accession process, Turkey has made significant progress
on water-related issues within the environment chapter, which was opened for
negotiations in 2009 under the Swedish Presidency. It is evident that the Directive
has had an impact on water management legislation and implementation
processes in Turkey within the context of EU-Turkey relations. At the same time,
it is apparent that Turkey has been unable to resolve issues such as fragmented
management and has faced significant difficulties during its EU accession
process. In this context, the study employed a literature review methodology to
examine in detail both EU environmental and water legislation and Turkey’s
environmental and water legislation, with the aim of assessing Turkey’s
compliance with EU criteria. Based on the findings, an evaluation of the subject
is presented in the conclusions section.
