Özet
منذ أن ألّف الإمام محمد بن إسماعيل البخاري كتابه (الجامع الصحيح) المشتهر باسم (صحيح البخاري)، أصبح أشهر كتب الحديث النبوي على الإطلاق عند أهل السنة والجماعة والكتاب الثاني بعد القرآن الكريم إلى يومنا هذا.
ولاشكّ عند أحد من أهل العلم أن الإمام البخاري هو محدث عالم، إلا أن بعض أهل العلم حسم أمر الإمام البخاري وصنّفه بأنه مقلد في الفقه، ومنهم من قال إنه شافعي والبعض نسبه إلى الإمام أحمد بن حنبل، لذا جاء هذا البحث بدراسة بعض تراجم أبواب الإمام البخاري في كتاب الإجارة من صحيحه، ومقارنتها بأقوال المذاهب الأربعة، والتي تثبت أن الإمام كان فقيهاً غير مقلد، ودوّن فقهه في أبواب كتبه التي سبقت الأحاديث في صحيحه.
ولقد اشتمل البحث على مقدمة دونت فيها أهمية البحث، وسبب اختياره، والمنهج المتبع في البحث، وخطة البحث، ثم بدأت المبحث الأول بذكر شيء من ترجمة الإمام البخاري، وألحقته بالمبحث الثاني في الحديث عن كتاب صحيح البخاري، ثم كتبت في المبحث الثالث الذي حمل عنوان دراسة عامة في فقه البخاري، عن فقه الإمام البخاري في صحيحه ومذهبه الفقهي ومسلكه في تراجمه، وأهم الكتب المصنفة في تراجم البخاري، ثم جاء المبحث الرابع والذي خصصته لدراسة بعض تراجم البخاري من باب الإجارة، والتي تبين من خلالها أنه وافق الجمهور في مسائل وخالفهم في بعضها، كما وافق بعض المذاهب وخالف أخرى في مسائل، ثم أنهيت البحث بخاتمة فيها نتائج وتوصية، ثم المصادر والمراجع، وأخيرا فهرس المحتويات.

Abstract
Since Imam Muhammad ibn Ismail al-Bukhari wrote his book Sahih al-Bukhari, it has become the most prominent book of the Prophet’s Hadith among the Sunnis (Ahlu Sunnah Wal Jama'a) and the second book after the Holy Qur’an to this day.
There is no doubt among the scholars that Imam al-Bukhari is a Hadith Scholar, but some scholars have classified him as imitated in jurisprudence, and some of them said that he was a Shafi’i and some said he follows the School of Imam Ahmad ibn Hanbal, so this research aims to study some of the interpretations of leasing in the second book of the Sahih Al-Bukhari, and comparing it with the opinions of the Four Schools of Thought, which proves that the imam was an original jurist who was not a copyist, and he recorded his jurisprudence in the chapters of his books that preceded the making of his Sahih.
The research included an introduction in which I wrote down the importance of the research, the reason for choosing it, the approach followed in the research, and the research plan. Then I started the first topic by mentioning something from the work of Imam Al-Bukhari, and attached it to the second topic when talking about the Sahih Al-Bukhari book. Then I wrote in the third topic, which bore the title “A general study in the jurisprudence of al-Bukhari”, on the jurisprudence of Imam al-Bukhari in his Sahih book, his jurisprudential doctrine and his conduct in his work. In addition to the most important books classified in the biographies of al-Bukhari. Then came the fourth topic, which I devoted to the study of some of Al-Bukhari’s opinions on the aspect of leasing, through which it was found that he agreed with the majority of scholars on issues and disagreed with them on some. Then I ended the research with a conclusion containing results and recommendations, then the sources and references, and finally the index of contents.
