Abstract
STUDY OF THE BROKERAGE CONTRACT AND CONCEPTUAL DISCUSSION
With the enactment of the Turkish Commercial Code No. 6102 in 2012, the Turkish Commercial Code No. 6762 dated 1956 was abolished. One of the aims pursued by this law is to simplify the language of the law. As a matter of fact, the law numbered 6762 does not reflect the period in terms of language. However, this simplification has led to the emergence of words that do not reflect the spirit and conceptual purpose of the law at some points. In this study, the assistant merchant who was included in the law numbered 6762 as "dellal" but could not find a place in the law number 6102 will be discussed. This concept, which was changed as "simsar" with the new regulation, is now included in the Code of Obligations No. 6098. Similarly, the Code of Obligations No. 6098 aims to simplify the Former Code of Obligations No. 818. On this occasion, it is essential to conceptually examine the assistant merchant who has been changed as "simsar" and examine whether it is a correct choice. In this study, the concept of broker will be explained, different aspects from similar concepts will be revealed and a suggestion will be made about the name.
