Abstract


THE RULE OF THEFT THROUGH INTERNET IN THE PROVISIONS OF THE ISLAMIC SHARIA
Internet fraud is defined as any manipulation of the computer and its system in order to illegally gain or inflict loss on the victim. Internet fraud is one of the modern crimes created by technological development, this network is used as a tool to commit the crime of theft, which can sometimes reach huge sums. It is well known that theft in Islamic law is a great sin that requires punishing and amputating, which will be executed if the amputating conditions were available. Therefore, in this research, I defined theft and the Internet in the introductory section, and then I began in the first section to study the elements of theft that necessitate for the cutting punishment (the legal content, the material content and the moral content). Then I moved in the second section to mention some kinds of stealing via the internet and the availability of elements of theft in them, and concluded the availability of theft elements that requires cut punishing in the (stealing credit cards) kind, if the thief used these stolen credit cards and the other considered terms were available to do the punishing, unlike the ( information stealing) via the internet, the cutting punishment won't be applied on the thief, because the information is benefits, and the "benefits" are not money as some scholars consider, so, the cutting punishment should not be applied to the thief, as they aren't quite sure, so the punishment should be reduced according to the Imam's jurisprudence in achieving deterrence, and the thief is obliged to pay the cost as a result of his deed.
