Abstract

THE NATURE AND COMPRISING SIZE OF THE WORLD “FATWA” IN THE CONTEXT OF THE ARABIC LANGUAGE AND LITERATURE
The word fatwa is about the religious life of the believers. Fatwa has also a guiding size for believers . Fatwa, which means solving anyone's problems on a religious subject, it has an important place in Islamic law. Because it is impossible for every believer to know Islam equally. In this respect, it is quite natural for the person who doesn’t know his Islamic problems to ask the person who knows. Even the Qur'an has advised the people who don’t know their problems to ask to any other one. In fact fatwa casus has started with the Prophet and of course the first mufti was himself. Prophet’s friends were asking what they didn’t not know to the prophet himself in religious context without any hesitation. The Prophet Hz. Muhammed, ,gave the required answer in accordance with the situation of the person. It can even be said that those who have the same problems did not get the same answer. Because Fatwa is also directly related to the psychological and physical power of the person who wants fatwa. It is a religious need that will continue as long as there are Muslims on earth. Because as in every fields, people's information is at a different level in religious field also. So someone always needs to ask others about their problems. In this study, we discussed the lexical and contextual meaning of the term of fatwa lingustic derivatives in the context of Arabic language and literature, and the differences between fatwa and judge decision, and the points whether it is binding or not.
