Özet
ABD’de çocukların ihmal ve istismardan korunması uzun yıllar devlet desteğinden yoksun, sivil toplum kuruluşları ile dinî cemaatlerin çalışmalarıyla yürütülmüştür. Kamu yönetiminin bu konuyla ciddî bir biçimde ilgilenmesi ve sorumluluk alanına dâhil etmesi ancak 1962 yıllarına rastlamaktadır. Kamuoyunun çocukların korunmasıyla ilgili duyarlılığının ve desteğinin artmasıyla birlikte kanun koyucular ve kamu yönetimi sorumluları bu alanda başlıbaşına bir yasal düzenleme ihtiyacının doğduğuna kanaat getirmişlerdir. Bu ihtiyacı karşılamak için, Çocukların İstismarını Önleme ve Tedavi Yasası (CAPTA) 1974 yılında yürürlüğe girmiştir. Kısa bir süre sonra da (1983 yılında) Nisan ayı Çocukların İstismarını Önleme Ayı olarak ilan edilmiştir. Böylece ancak, 20.yüzyılın son çeyreğinde çocukların korunması ve istismarlarının önlenmesiyle ilgili sistematik çalışmalar başlayabilmiştir. Bu çalışmanın amacı, ABD’de Çocuk İstismarını Önleme Yasası’nı (CAPTA) genel olarak incelemek ve Türkiye bağlamında ders ve sonuçlar çıkarmaktır.

Abstract
In the United States, the protection of children from neglect and abuse has been carried out for many years without the support of the state and the activities of non-governmental organizations and religious communities. It is only in 1962 that the public administration has taken a serious interest in this issue and included it in its area of responsibility. With the increasing public awareness and support for the protection of children, the legislators and the public administration authorities have come to the conclusion that there is a need for legal arrangements in this area. In order to meet this need, the Law on Prevention and Treatment of Children (CAPTA) entered into force in 1974. Shortly thereafter (in 1983) April was announced as the Month of Prevention of Child Abuse. Thus, in the last quarter of the 20th century, systematic studies on the prevention and protection of children were started. The purpose of this study, the Prevention of Child Abuse Act in the United States (CAP) is generally examine and draw lessons and conclusions in the context of Turkey.
